In the latest ruling in a case begun in 1992, the U.S. District Court of Arizona has ordered the state to begin adequate funding of programs for English language learners or be fined $500,000 per day for 30 days. 160,000 English-language learners have been exempted from state high school exit exams until the matter is resolved. The defense argued that federal funds for ELLs are not being taken into account, and that the students' motivation is waning now that they may not have to take the exam.
